Bug Digest Settings: Cannot select Valid user criteria

When selecting the user criteria for the digest, I'm unable to select only "User State: Valid". I check the box and click save, it returns to the digest list screen, I check the settings, and the box is unchecked. However, if I also select User State: Awaiting Email Confirmation it will save it.

Confirmed on both test and production servers.
