I've found the problem. Redownloading the Branding Free in your downloads are as well as the latest Beta 10 of Classifieds will help sort this. Reupload the Classifieds file (no need to reimport the XML product file) and get the update Branding Free key from the Branding Free package.

That should fix the error you're getting while also removing Copyright footer.

It fixed the error in the vB Admincp but didn't remove Copyright footer so I imputed the previous key to remove BF but the error is back.

So just to double check...

You downloaded Beta 10, reuploaded them to the server.

Then you got the updated key details by redownloading the Branding Free package and using that in the settings?

I've just tried this on my test site and it's worked fine. Do you have any sort of caching system in place? If not and the above sequence doesn't work, try importing the XML just in case that sorts the system out.
